Non-residents who do not have permanent residence or have legal persons headquartered in the Czech Republic could buy property in the Czech Republic before the Czech Republic enters the European Union. Following the accession and especially after the adoption of the recent Foreign Exchange Act amendment, the acquisition of real-estate property in the Czech Republic has become much easier for foreigners, and particularly for nationals of the Member States of the European Community.


Although real estate in the Czech Republic may be owned by anyone under certain circumstances, it is not always so simple. Although no limits are imposed on a certain number of persons in this regard, other cases may differ regarding persons wishing to acquire a Czech property and the different types of property.




The following categories of persons can buy real estate without any restriction in the Czech Republic:




The Czech Republic's citizens;


Legal entities with their Czech headquarters;


Czech Republic foreigners with a permanent residence permit;


People in the Czech Republic who were granted asylum.


Certain restrictions on the acquisition of real estate apply to the following categories of people:




Persons wishing to acquire properties other than those provided for in paragraph 2 below:




(a) EU Member State nationals holding a residence permit for a Member State of the European Community;




b) nationals of other States – in cases expressly referred to in the law only, e.g. by legacy, for a diplomatic mission of state, a relative, a sibling or a spouse, and so on.




C) legal entities located in and authorized to do business in the Czech Republic, otherwise solely in the same circumstances as people who are not nationals of an EU Member State.




Lands of agriculture and forest




This type of property is subject to different, stricter regulations compared to other types of property (see below). Nationals of EU Member States wishing to acquire such land shall comply with other conditions, in addition to being holders of a residence permit. All other persons and entities may only acquire such property in cases explicitly provided for in the law.


To give a complete overview, the rules applicable to the acquisition of immovables by EU Member States' citizens also apply, pursuant to the international treaties, to the citizens of the European Economic Area Member States, the United States and Switzerland.
